The legal duty
Regulation 7 of the Management of Health & Safety at Work Regulations 1999 requires every employer to appoint one or more competent persons to assist in complying with health & safety law. It sits on top of your overarching duties under the Health & Safety at Work etc. Act 1974 — and it isn't optional.
The Regulations are clear that you should look inside your own organisation first, but where you don't have someone with the right skills, knowledge, experience and training, you must bring in external competent advice.
